By accessing or using SmartListingTool at www.smartlistingtool.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site. These Terms are governed by the laws of England and Wales.

2. Description of Service

SmartListingTool provides free AI-powered copywriting assistance for e-commerce sellers. Our tools generate product descriptions, ad copy, email templates, listing content, and other marketing text based on your inputs. All outputs are generated using large language model technology provided by OpenAI.

3. AI-Generated Content — Important Disclaimers

You understand and agree that:

• All content generated by our tools is produced by artificial intelligence and may contain errors, inaccuracies, or omissions.
• AI outputs are suggestions only. You must review, verify, and edit all generated content before publishing or using it in any commercial context.
• We make no warranty that AI-generated content is accurate, complete, suitable for any particular purpose, or compliant with any platform's policies (including but not limited to Amazon, eBay, Shopify, Facebook, Instagram, or TikTok).
• You are solely responsible for any content you publish, advertise, or otherwise use that was generated using our tools.
• AI-generated content may occasionally resemble existing content. We make no guarantee of originality. You are responsible for ensuring your published content does not infringe third-party intellectual property rights.
• You must not use AI-generated content to make false, misleading, or unverifiable claims about products — including medical claims, guaranteed performance claims, or fabricated reviews or social proof.

4. Acceptable Use

You agree not to use the Site to:

• Generate content that is false, deceptive, misleading, or fraudulent
• Generate content that violates any applicable law or regulation
• Generate spam, bulk unsolicited communications, or malicious content
• Attempt to circumvent our rate limits through automated means, proxies, or other methods
• Scrape, crawl, or extract data from the Site using automated tools
• Resell or commercially redistribute access to our tools without our written permission
• Generate content that infringes the intellectual property rights of any third party
• Use the Site in any way that could damage, disable, or impair our infrastructure

5. Intellectual Property

The Site, including its design, code, and original content, is owned by SmartListingTool. You may not copy, reproduce, or redistribute the Site itself without permission.

AI-generated outputs produced using our tools are provided to you for your own use. We do not claim ownership over the outputs generated from your inputs. However, given the nature of AI-generated content, we make no warranty of originality or non-infringement.

6. Rate Limits and Fair Use

We provide 3 free generations per day per IP address. We reserve the right to modify, reduce, or remove this allowance at any time. Attempts to circumvent rate limits may result in your IP being blocked from the Site.

7. Disclaimer of Warranties

THE SITE AND ALL CONTENT, TOOLS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content.

8. Limitation of Liability

To the fullest extent permitted by applicable law, SmartListingTool shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the Site or its tools
• Any content generated by our tools that you publish or use commercially
• Platform policy violations resulting from use of our generated content
• Any loss of business, revenue, data, or profits

Our total liability to you for any claim arising from your use of the Site shall not exceed £100 or the amount you paid us in the 12 months preceding the claim (whichever is greater). As the Site is currently free to use, our liability is limited to £100.

9. Third-Party Platforms

Our tools are designed to help create content for third-party platforms including Amazon, eBay, Shopify, Facebook, Instagram, TikTok, and others. We are not affiliated with, endorsed by, or partnered with any of these platforms. Each platform has its own content policies — you are responsible for ensuring your content complies with the rules of any platform where you publish it.

10. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Site or any of its tools at any time without notice. We may also update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
